- Alberta gives you 10 days to cancel a new condo purchase agreement, with a full deposit refund within 15 days.

Canmore pre-construction condos come with a different rulebook than resale. You are buying a set of promises. A floorplan, an occupancy date, a budget that has not been tested, and Alberta's Condominium Property Act gives you specific protections in exchange. Add 5% GST, a rebate system that changed materially in 2025, and assignment rules that changed in 2022, and the paperwork matters more than the show suite. Here is how it works, and what is actually being built here.
How do deposits work on Canmore pre-construction condos, and what protects them?
Your deposit and any further payments must be protected by an approved purchaser protection program, a trust account managed by a prescribed trustee, or both. Ask which applies to your project and get it in writing.
The purchase agreement has required contents too: estimated monthly contributions based on the actual or proposed budget, the unit factor and how factors were allocated, and, where the unit or common property is unfinished: the floor plan, finishing materials and the location of parking, walkways and recreational facilities.
Can you cancel?
Yes, on a clock. You may cancel within 10 days of signing the purchase agreement, or within 10 days of receiving all required disclosure documents if those arrived later, with your deposit refunded in full within 15 days.
You get a second exit if the building runs late. The developer must give you an occupancy date statement with a final occupancy date, and at least 30 days' written notice of the specific date if a range was given. If the unit is not ready within 30 days after the final occupancy date, you may cancel any time up to 10 days after receiving notice of a new final date, though delays from causes beyond the developer's control, including fire, flood, a declared public emergency and development permit delays, are excused if proper notice is given.
How does GST work on new Canmore condos?
Alberta has no HST, so new construction carries 5% GST on the purchase price. Two rebates exist and only one is useful here.

The old rebate is effectively dead at Canmore prices. The first-time buyers' rebate is the one worth structuring around. To qualify you must be at least 18, a Canadian citizen or permanent resident, and not have lived in a home you or your spouse owned as a primary residence in the calendar year or the previous four calendar years. The home must be your primary place of residence, you must be the first person to occupy it, the agreement with the builder must be dated on or after March 20, 2025 and before 2031, construction must begin before 2031 and be substantially complete before 2036. The CRA's own example: a $1.25M home sits at the phase-out midpoint and qualifies for $25,000.
Note what that excludes here. A second home or weekend condo does not qualify, since both rebates turn on the primary-residence test.
Can you assign a pre-construction contract?
Sometimes, and it is taxable. Assignment normally requires the builder's consent under the terms of your agreement, and the builder's assignment fee is itself generally subject to GST. Since May 7, 2022 all assignment sales of new or substantially renovated housing are taxable for GST/HST purposes, and the tax applies to the full assignment price, including the portion that simply recovers the deposit you paid the builder.
Two further traps. The first-time buyers' rebate is not available where the original agreement was entered into before March 20, 2025 and is later varied, amended or assigned. And only the builder who sells you the home can credit a rebate to you. An assignor cannot, so an assignee who paid tax to both usually has to file directly with the CRA rather than through the builder.

What is actually being built in Canmore right now?
Plenty, though not all for sale to individual buyers. From the Town's major planning applications page, August 2026:
- Three Sisters Village Phase 1, 94 stacked townhouse units in ten buildings at 200 Yarrow Road, and 249 units in two five-storey apartment buildings at 700 and 800 Village Road, both approved in June 2026; 76 townhouse and stacked townhouse units at 100 Village Road are under review.
- 1800 Spring Creek Gate, a 112-unit apartment building of three to four storeys including six perpetually affordable housing units and one commercial unit, approved in 2026. The finished lodges next door are compared in the Spring Creek guide.
- 300 Mountain Tranquility Gate. A 70-unit, four-storey apartment building with tourist homes, approved May 2026.
- 1651 Palliser Trail, 120 rental residential units with ground-floor commercial, approved April 2026. Rental, not for purchase.
- Smith Creek, conceptual scheme approved October 2025 for roughly 53 acres of phase-one residential land, awaiting subdivision.

What this means if you're buying
Treat the disclosure package as the product. Use the 10-day window for a lawyer's review, sanity-check the proposed budget against fees in finished Canmore condos, and confirm the zoning designation before you assume anything about nightly rental.
